酒測值0.07毫克　不算酒駕不起訴

宜蘭縣1名54歲的莊姓男子，1個多月前，駕駛小貨車遭一輛自小客從後追撞，警方到場處理，並對2名駕駛做酒測，莊男被測出酒測值0.07毫克，且無法通過「閉雙眼，30秒內朗誦1001到1030」及「畫同心圓」2項生理平衡檢測，被警方認定無法安全駕駛，依公共危險罪嫌移送法辦。

檢察官庭訊時，莊男雖坦承肇事前一夜喝了點啤酒，但辯稱他是在隔天上午8時多才開車，已過了9個多小時，不影響駕駛，堅決否認酒駕犯行。

檢察官檢視莊男接受生理平衡測試錄影帶，發現莊男並無語無倫次、意識不清等酒醉狀態，且酒測值0.07低於標準值0.25毫克，車禍原因又是被他車自後方追撞，認為無證據足認莊男涉有公共危險犯行，今天做出不起訴處分。（潘岳／宜蘭報導）
