紅衫軍總指揮施明德因不滿遭前國策顧問黃越綏等人指控侵占紅衫軍捐款等，日前提告求償，最高法院經審理後，判決黃越綏應該賠償新台幣100萬元。

法院判決書指出，施明德主張，台南市議員王定宇指稱倒扁總部帳目不清，募款方式是詐騙集團；閃靈樂團主唱Freddy（林昶佐）指紅衫軍是最大的詐騙集團；前總統府國策顧問黃越綏指施明德「好像俗辣」、拿錢帶著老婆小孩到國外等。施明德提告求償、請求登報道歉。

王定宇等人稱，質疑反貪腐承諾金的帳目屬個人意見並非陳述事實，此言論為涉及公益且可受大眾公評的事，並無惡意批評施明德。

最高法院2日判決黃越綏、林昶佐應各賠償施明德100萬、50萬元，並登報道歉確定；王定宇部分則廢棄，發回台灣高等法院。
