上網賣隱形眼鏡觸藥事法　無犯意不起訴

【蔡進男／基隆報導】上網賣眼鏡，差點吃上官司！基隆市20歲楊姓女子與37歲廖姓女子合作，在網路上販賣隱形眼鏡，楊女接到買家訂單後，再向中國友人購買價格較低廉的隱形眼鏡販售，藉此賺取價差。2名女子被調查局基隆市調查站依違反《藥事法》逮捕，訊後移送法辦。

2女辯稱，並不知道隱形眼鏡屬於醫療器材，因為看到網路上有人販賣，所以才會想藉此賺錢；檢方認為眼鏡行林立，都有販售隱形眼鏡，且許多明星在電視上大力推銷，卻不見有任何警語，一般民眾不會知道隱形眼鏡屬於醫療器材，而不得任意販賣，衛生主管機關有義務再加強宣導。全案偵結，以不起訴處分。
