看完同一個主題的文章，提出一些想法。 一、 消基會服務人員表示「對於使用才三個月的手機，消費者有權益要求更換新品」 或許這個消基會的誤導你，更換新品主要是針對購買後的七天內， 保固期內廠商的做法多半是原機維修、更換相關零件(機板之類的)， 除非他們搞不定有問題的手機，消費者才會要求更換新機或其他手機。 二、 消保官調解有沒有送法院核定？調解書沒有送法院核定，並不會產生判決效力。 (還是說，你們只進行了「申訴」階段，尚未進入「調解」程序？) 原PO 9/25的文章有這段： 消費者服務中心人員表示「我只要憑著，有問題無條件換新機這點，贏面就很大了。」 如果你們調解成功，並有法院核定，根本具有判決效力，哪來贏不贏的問題。 三、 流程中一些奇怪的細項： 1.Sony方A先生是誰？他的職務是什麼？能如何代表Sony？ 2.一隻不能用保護貼的手機是什麼情況？難以想像。 3.Sony方拒絕提供不涉及商業機密的資料，可以寫在訴狀內給法官心證。 4.如果你確實想打贏訴訟，還是找專業的法律諮詢和律師， 　幾篇看下來，你持續得到不完整甚至錯誤的資訊，只是在浪費時間做白工。 5.話說..你的手機在神腦拿的，當初怎麼沒有考慮走神腦這條路。 -- ※ 發信站: 批踢踢實業坊(ptt.cc) ◆ From: 175.96.231.22 ※ 編輯: SuLiaen 來自: 175.96.231.22 (10/10 12:09)
