【更新】砸蛋糕的代價　夫妻鬧上法院

很多人在特殊節日時，都喜歡砸蛋糕慶祝，不過，桃園卻有一對夫妻因砸蛋糕鬧上法院，最後離婚收場。

桃園張姓男子（32歲）與黃姓妻子（30歲，兩人已離婚）相處不睦，今年5月11日晚黃女欲開車外出時，兩人發生嚴重口角，張男氣憤難耐，拿了家中一盒蛋糕砸向坐在駕駛座的黃女。

案經黃女提出毀損告訴，張男坦承犯行；惟因黃女事後把車開到洗車廠清洗、身上沾了蛋糕的衣服在清洗後也沒問題，桃園地檢署認為黃女座車和衣服在清洗後還能使用，並成構成毀損罪「須達致令不堪使用之程度」等，因此予以不起訴處分。

另外，一名扶輪社的前社長，2007年時在100名中小企業老闆出席的公開聚餐會議上，對著另外一名前社長砸蛋糕，被對方告上法院，結果遭依公然侮辱罪，判拘役40天，易科罰金4萬元。（張沛森／桃園報導）
