清醒狀態不構成乘機性交　男子獲判無罪

【潘岳／宜蘭報導】宜蘭一名33歲賴姓男子，1年多前，應林姓女子要求，開車到KTV搭載林女到汽車旅館休息，並發生性關係，不料，林女事後反悔指控賴男趁她酒醉予以性侵，致賴男被宜蘭地檢署依涉嫌乘機性交罪嫌起訴。

宜蘭地院調閱林女手機通聯記錄，發現林女入住汽車旅館途中頻頻與吳姓男友通話，汽車旅館員工也證稱林女入住時眼睛是睜開的，並無醉倒情形，據此認定林女當時並無泥醉情況，2人發生性關係係妳情我願，判賴男無罪。
