【公庫】文明與進步？廢死論述的兩難

有朋友讀過我在在《鬼島生與死研討會》上所發表的文章（《台灣死刑制度之全球/在地的辯證發展》），問我：
1. 如果不去宣揚「廢死」的「現代」、「文明」、「進步」，以及其如何是「現代」、「文明」、「進步」的理由，那麼又為什麼要「廢死」？
2. 「死刑」不僅僅是中國的傳統刑罰制度，其實它根本就是人類社會的傳統刑罰制度。不是正因為我們認為此一傳統已不適合於現代社會，才要廢止它嗎？
3. 如果不說出死刑的缺點且聲稱它已不適合現代社會，那麼我們又為什麼要廢止這個傳統？（更多內容請點入）
