還我招牌！　車商終止契約法院判拆還

2011年底，台中西屯區萬仕達汽車商行與匯豐汽車股份有限公司簽訂「SUM優質車商聯盟會員合約書」，由匯豐汽車建置提供招牌使用，但雙方於去年底提前終止契約，匯豐汽車要求萬仕達車商拆還招牌被拒，因而提告，台中地院判決，雙方既已終止契約，萬仕達即無權占有招牌，必須拆還招牌。

判決指出，匯豐汽車以萬仕達車商未達年度簽約業績，於2013年間提前解除雙方契約，並聲請強制執行萬仕達車商簽訂的21萬餘元本票，法院判決匯豐汽車敗訴。
 
匯豐汽車不滿無法透過強制執行本票的方式，取回替萬仕達車商建置的招牌等損失，乾脆提告拆除招牌返還，台中地院指出，雙方先前提告內容僅爭執本票債權存在與否，與招牌所有權歸屬無關，由於雙方契約已終止，萬仕達車商已無正當權源占有招牌，判決必須拆還原告。 (許淑惠／台中報導)
