通保法救濟程序 已生效

刑事訴訟法關於監聽的救濟規定已經生效，司法院刑事廳長蔡彩貞指出，不服監聽的民眾，即日起可於收到監聽通知及所附的通訊監察書後，向法院提起抗告，由法官審查監聽是否違法。

立法院日前三讀通過「通訊保障及監察法」及「刑事訴訟法」修正規定，總統於農曆年前的1月29日公布，其中規定監聽救濟機制的刑事訴訟法已於公布的第3天生效。

蔡彩貞指出，依通保法規定，監聽結束後，應通知被監聽人，但沒有救濟的程序。此次修法，在刑事訴訟法第404條、416條增加救濟規定。

亦即，法官於監聽結束後，除了會通知被監聽人，讓民眾知道自己被監聽，還會附上記載案件事由、監聽期間等內容的通訊監察書，讓不服監聽的民眾可對之提起抗告或聲明異議。

蔡彩貞表示，不服監聽的民眾必須在收到通知後5天內提出抗告或聲明異議，就監聽違法，必要性、監聽期間等表示不服，由法官審查監聽有無不法。
