「跟你做愛很舒服」　直白對話不算通姦

【郭芷余／高雄報導】高雄一名丁姓婦產科醫生（52歲）的妻子2010年間在美國住家的電腦中，發現丈夫與護士自拍多張裸照、及MSN的火辣對話，其中提到親熱、做愛、要吃避孕藥等，丁妻怒告通姦。但檢方認為照片沒拍到下半身，也沒有扣到沾有兩人分泌物的保險套，無法證明2人有性行為，處分不起訴。

丁姓醫師與女護士僅承認2人有擁抱，不承認做愛，女護士辯稱有子宮肌瘤，才要吃避孕藥改善子宮內膜厚度，丁男也提出自己曾用英文向女護士解說吃避孕藥的治療效果抗辯。

至於2人MSN內容如「希望你在旁邊，可以親熱」、「這次period（指月經）結束，我要吃避孕藥」、「跟你having sex很comfort」（中譯：跟你做愛很舒服）等對話也不被檢方採納作為通姦證據。檢方認為「親熱」可能是親密動作，話說得露骨也不代表有做愛，將2人不起訴。
