立院三讀《專利法》　增專利權人邊境保護

【李英婷／台北報導】為比照主要競爭對手國建立專利的邊境保護措施，立法院今三讀通過《專利法》增訂部分條文修正案，當專利權人認為進口物品有侵害其專利權之虞者，得以書面申請海關先查扣，並說明侵害事實，及提供相當於海關核估該進口物完稅價格的保證金。

提案修法的國民黨立委李貴敏表示，美、韓、日及中國等國都有法律落實專利邊境保護，而外國競爭廠商也善用其國智慧財產邊境保護措施，有效防阻外國競爭產品的進口。因此，倘若台灣未訂定相關措施，我方廠商只能處於挨打立場。

李貴敏說，《專利法》修正通過後，將是國內廠商在國際談判時的重要依據，讓廠商萬一在國外遭控有侵權之虞，也可採用該制度反制。
