標題[問題] 電話續約、違約之問題

板友好， 小弟的阿閃家裡碰到一個問題，一陣子之前，某電信業者打電話向阿閃的阿嬤推銷新合約 內容是網路吃到飽、送一隻手機，但是阿嬤是個年近八十的老人家，完全用不到上網功能 當下就被業者給說服了，阿閃得知之後十分生氣， 他最近也不斷在詢問有沒有直接退掉的可能，因為現在的違約金要12K... 我是覺得電信業者雖然握有"錄音"，但是其舉動確實有可議之處， 畢竟年齡資料業者一定有，向一個年近八十的老人家推銷網路吃到飽到底是何居心.. 但我不太懂這部分有沒有相關法規，故來請教各位 目前業者提出的選擇：1.給降費率，到合約完(約17K) 2.違約金(約12K) 另外，也有詢問過消保官，消保官的意思是向該業者積出存證信函 這部分的話我也不是很清楚了，不過就業者1.的回應態度我認為他們是仍有保留？ 想請問有沒有板友遇到類似的合約問題呢？該怎麼解決比較好 十分感謝 -- ※ 發信站: 批踢踢實業坊(ptt.cc) ◆ From: 140.113.46.38
