老公找女同睡一床　雖未通姦但要賠妻40萬

【蔡進男／基隆報導】巫姓男子與黎姓按摩女郎同居，去年1月間被老婆察覺，3人見面談判後，2人允諾不再見面，沒想到今年7月8日，巫妻再度發現先生又跑去找黎姓女子，會同警方到場，當場逮到巫男僅著內褲、黎女穿著睡衣睡在一起，但是2人否認發生性行為，檢警事後也查無明確証據，不予起訴。

但是巫妻身心極度煎熬，還是向2人請求精神上損害賠償，求償慰撫金60萬元；黎女向法官解釋確實與巫男發生過10次性行為，但去年被巫妻發現後就不再與巫男有瓜葛，法官認為即使2人未通姦，但衣衫不整共睡一床，已違反善良風俗，可以想像巫妻精神上大痛苦、折磨，判決2人應連帶賠償40萬元，全案仍可以上訴。
