大統油品摻假事件再度引起社會恐慌，主管機關未能嚴格把關，已讓台灣的食品安全拉警報，若再考量事後求償的困難，如塑化劑風暴，消基會替消費者向廠商求償25億的賠償金，第一審卻僅判賠120萬，恐更使問題雪上加霜。
依《民法》第184條第1項，欲請求侵權行為的損害賠償，須證明行為人有故意或過失的不法侵害，始足當之。只是所謂故意或過失，乃存在於人之內心，如何證明，實有困難，尤其若造成侵害者為大型企業體，關於此等主觀，恐更難為認定。為了消除如此的困境，《消費者保護法》第7條第1項即規定，只要從事生產、製造商品之企業經營者，對於其所提供之商品，若未能確保符合當時科技或專業水準可合理期待之安全性，因此所造成的損害，即便無故意或過失，亦應負損害賠償責任，此即為商品製造者與企業經營者的無過失責任。
又類似塑化劑所引起的食品傷害場合，由於被害者眾，若個別向廠商為求償，不僅曠日廢時，更會陷入小蝦米對大鯨魚的困境。為了解決此困難，《消費者保護法》第49條第1項，才沿襲德國法制規定有，因同一原因所造成的消費者被害，若有超過二十人者，就得將其訴訟權限移轉給消費者保護團體，既可調整消費者與企業體的地位差，更可降低消費大眾不願進入訴訟的障礙。
惟就算現行法已對消費大眾採取一定的訴訟保障，且在塑化劑風暴裡，亦由消基會替消費者向廠商提起團體訴訟，但由於民事訴訟乃採處分權主義，就證據調查而言，須由當事人為舉證，法院原則上不能為職權調查。也因此，原告雖因消保法採無過失責任，致無庸舉證企業經營者有無過失，卻仍須為因果關係之證明。而由於法庭上的證明，不能基於一種臆測，故即便塑化劑不得成為食品添加物乃為常識，但是否會因此造成身體的損害及受害程度為何，仍須受專業的檢驗。若原告方無法提出確切的醫學報告為證明，法院基於中立第三者的角色，自無從判定此等的因果關係存在，致暴露出「舉證所在、敗訴所在」的窘境。 (接下一頁)

【王立德／台北報導】財政部推奢侈稅修法，檢討報告將於下月出爐，國票金董事長魏啟林今日表示，國內民間資金充裕卻不參與投資，跑去房地產炒高房價，「對不起年輕人」，因此對於持有第3棟以上房產，「交易課30%、50%奢侈稅都可以」。
魏啟林說，財政部去年把證所稅列為稅改優先，方向錯誤把自己搞的滿臉豆花，房屋供給是有限的，容易淪為炒作標的，股票可以加印（增資）是無限，政府卻去打擊資本市場，沒有資本市場，「會有創新嗎？」

【張貴翔／新北報導】新莊區八德街1處家庭理髮廳，今天上午10時許發生一起命案。打扮美艷的中國籍41歲于姓女老闆于瑞琴被發現倒臥血泊，警方到場發現女子已死亡多時，死者身上無明顯外傷，疑頭部遭重創死亡，警方查出于女在中國有婚姻記錄，也有孩子，再婚來台。
皮鞋店老闆娘告訴警方，與理髮廳分租同一店面，死者獨自開店，平時住在店裡，她的丈夫偶爾會來，今天上午要去廚房拿東西，兩戶共通門卻反鎖，呼喚于女卻無回應，拉開按摩室窗簾，透過窗看見于女倒地。

大統長基食品公司董事長高振利涉嫌在橄欖油等四十八種油品內摻入棉籽油、銅葉綠素等販售，彰化地檢署昨以違反食品衛生管理法、詐欺罪嫌將他起訴，並認為高振利涉偽摻油品長達七年，不法所得高達十八億五千餘萬元，除建請法院全數沒收，並請從重量刑，刑期最重可達卅年。

【吳國仲／新北報導】因網路影片「史上最強爆乳酒促妹」瘋傳而爆紅的酒促妹晴晴，昨晚10時許前往永和永貞路1家酒吧內推銷，還在臉書上留言號召大家來捧場，結果真的引來大批男客前往一親芳澤。
但酒吧外被大批媒體團團包圍，酒吧員工表示，晴晴的公司怕影聲譽，所以婉拒採訪，眾家媒體不得其門而入。客人爭睹的結果，把上班的晴晴嚇得花容失色，今天凌晨0時許，酒吧老闆Kevin只好請她先下班回家。為躲避媒體拍攝，晴晴走出酒吧時遮頭遮臉，快閃進計程車，慕名而來的男客們均一臉納悶，幾位後到的客人，不知已撲空，還不停詢問酒促妹人在那裡。
24歲住永和的喻先生說，有看過該支網路影片，是在臉書上看到朋友轉貼的訊息，才相約與朋友過來看看；對於晴晴在影片中火辣的酒促方式，他認為太誇張，有可能是與朋友套好的，但也認為這對業績有幫助，會受到男酒客歡迎。

23歲的小川，大三時拜讀大聯盟三振王萊恩(Nolan Ryan)所著的《投手聖經》一書後，投球時開始仿效萊恩的高抬腿動作，因而贏得「和製萊恩」和「萊恩小川」的封號，今年他戰績16勝4敗、防禦率2.93，不但是央聯勝投王，3場完封也並列日職最多。
