拉法葉案定讞 追討百億佣金

（中央社記者陳亦偉台北16日電）拉法葉艦採購弊案，最高法院今天判刑前海軍上校郭力恆15年，追繳百億不法所得定讞。這個定讞判決，意味台灣終可向瑞士申請返還汪傳浦被凍結的新台幣100多億元佣金。

民國82年爆發的海軍上校尹清楓命案及所衍生的軍購弊案佣金追討，一直是司法單位的難題。儘管尹清諷命案因諸多證據已遭破壞，難有突破，但追討佣金部分，近年多有進展。其中台灣透過司法互助，請瑞士凍結軍火商汪傳浦帳戶的鉅額佣金，最為關鍵。

拉法葉艦購艦弊案爆發後，台灣透過國際司法互助，請瑞士檢方凍結軍火商汪傳浦帳戶內的鉅款，經多年孳息，已超過9億美元。瑞士檢方多年來一直告訴台灣司法部門，取得與汪傳浦有關的定罪判決，才可返還帳內款給台灣。

目前瑞士檢方凍結汪傳浦在列支敦斯登、盧森堡、英屬開曼群島等帳戶的款項約為9.6億美元。偵辦拉法葉弊案的特偵組研判，其中約6成是拉法葉購艦案佣金，4成是幻象戰機採購佣金。

台北地方法院一審時，僅認定郭力恆所涉不法所得1758萬美元，且把郭力恆與汪傳浦切割，若照台北地院的見解，台灣幾乎無法取回汪在瑞士的鉅款。

直到去年台灣高等法院庭長蘇素娥、受命法官宋松璟、陪席法官王偉光組成的合議庭，改認定應追討的不法所得約3.4億美元，而非一審所認的1758萬美元，讓維護國家利益出現曙光。

拉法葉艦軍購弊案當年震驚中外，台灣海軍向法商請求佣金賠償的仲裁官司，直到民國100年7月才勝訴，法方需償還海軍約8.7億美元（約新台幣260億元）的違約金。

如今隨拉艦弊案的定讞，台灣可望再取回約新台幣104億元不法所得，軍、檢、法院為中華民國討回的國家利益，值得國人讚許。1030416

漁船擱淺 4人游彭佳嶼獲救

有漁船載工程師上彭佳嶼維修氣象站無線電，意外擱淺；海巡隊救回工程師，船長等4人留守，因船身傾斜跳海游上島獲救。

深澳籍漁船「陽明66號」搭載兩名電信工程師上彭佳嶼維修氣象站無線電，船駛近彭佳嶼時卻突然失去動力後擱淺。

船上除兩名工程師外，還有陳姓船長及1名船員、3名印尼籍漁工，船長通報求救。基隆海巡隊今天近中午接獲海洋總局轉漁業電台通報，派出艦艇前往救援，於下午4時20分載船員及工程師安全返航。

不料近晚間7時，擱淺的漁船在強大風浪拍擊下，船身持續傾斜，最後因船身過度傾斜，船長及漁工等4人被迫跳海游上彭佳嶼獲救，目前安置島上的海巡雷達站內，至於擱淺漁船將視明天海象狀況再拖救。

自然界中存在著令人咋舌的擬態例子，讓觀察家除了讚嘆還是讚嘆。如動物界中的蘭花螳螂，存在東南亞的熱帶雨林，外表比真蘭花還美，偽裝成花朵以便捕食採蜜的獵物。

植物界的擬態也很精采，植物專家陳坤燦表示，原產澳洲的鐵鎚蘭Hammer orchid 花朵的唇瓣模擬成雌蜂的腹部，欺騙雄蜂前來交尾，雄蜂停下來的瞬間，唇瓣會彈起來將雄蜂打到蕊柱上，讓雄蜂身上沾黏花粉；另外，原產歐洲的蜂蘭Bee orchid類的蘭花，唇瓣也模擬成雌蜂的樣子，吸引雄蜂交尾，同樣達到傳播授粉的目的，只是蘭花長得如此激似雌蜂，被騙做白工嘿咻的雄蜂就真的冤枉了。（劉燕美／台北報導）

《美國經濟》3月工業生產勝預期，連2月成長

美國工業生產連兩個月上揚，聯準會(FED)16日公佈，3月份工業生產指數月增0.7%(年增3.8%)至103.2(2007年基期=100)，且2月份數據上修至月增1.2%。據路透社調查，經濟學家原預估3月份工業產出將月增0.5%。

佔工業產出比重75%的製造業月增0.5%、年增2.8%；礦業月增1.5%、年增7.9%；公用事業月增1%、年增4.4%。

工業產能利用率由前月的78.8%上揚至79.2%，僅較長期平均值(1972年至2013年)的80.1%低0.9個百分點。製造業產能利用率自前月的76.5%上揚至76.7%；礦業自88.2%上揚至89.1%；公用事業自84.2%上揚至85%。

產能利用率是FED利率決策的參考指標之一，過低顯示企業設備被閒置、景氣偏弱，寬鬆貨幣政策將不會改變。反之，產能利用率若過高則有景氣過熱、通膨上升之虞，FED有可能升息調節景氣。
