「移植」鄰百株包心芥菜苗　老翁判罰3千

北市文山區74歲張姓老翁去年底在住家附近，偷附近菜農100株共值300元包心芥菜苗，並將部分菜苗移植到自己的耕作的菜園，遭菜農當場拍照存證後報警，台北地院依竊盜罪判張翁罰金3千元，被害菜農認為判太輕不服上訴，二審北院合議庭仍駁回上訴，全案確定。

判決指出，張翁平時務農，因年紀大且經鑑定確認有輕微失智症，認定張翁因認知退化造成判斷錯誤，誤以為與對方有交情就「拿取」菜苗，但法官審酌他事後坦承犯行，又有失智症，因此依竊盜罪輕判張翁罰金3000元確定。（張欽／台北報導）
