關鍵字廣告搭便車 判翻譯社罰10萬元

謙慧公司旗下有華碩、五姊妹、哈佛等多家翻譯社，但謙慧去年在雅虎、Google刊登關鍵字廣告，使用競爭同業「詮星」翻譯社名稱插入廣告中，廣告呈現「華碩全球翻譯多語翻譯公司-詮星」、「五姊妹翻譯公證-詮星」及「哈佛各國語言翻譯公司-詮星」，導致民眾若在上述網站輸入「詮星」搜尋，排在前面的卻是華碩等翻譯社的廣告及連結。

詮星認為謙慧此舉如同搭便車，目的是增加華碩、五姊妹及哈佛翻譯社的曝光量及使用者造訪機會，怒向公平會投訴。公平會調查後認定謙慧的作法確實使民眾誤以為他們的翻譯社與詮星是同一來源、同系列產品或關係企業，而謙慧榨取他人努力成果，影響交易秩序，去年依《公平交易法》罰謙慧10萬元。謙慧打行政訴訟抗罰，但台北高等行政法院認為公平會開罰有理，日前判謙慧敗訴。可上訴。(丁牧群／台北報導)
