祁家威同性婚欲登記 被最高法院駁回

積極爭取同性戀權利的男同志祁家威，去年與同性伴侶結婚，持申請書、證人簽名的結婚證書向台北市萬華戶政事務所辦理結婚登記，被戶政所打回票，不准登記。祁打行政訴訟要求准予登記，今年三月被台北高等行政法院駁回。祁上訴最高行政法院。最高行政法院審理後，看法與台北高等行政法院一致，今天判決駁回上訴，全案定讞，不得再上訴。

法院的理由是民事規定，：「婚約，應由男女當事人自行訂定。」 ，以及公民與政治權利國際公約規定：「男女已達結婚年齡者，其結婚及成立家庭之權利應予確認。」，均認定男與女才能結婚。
