一名男子和小他1歲的國中學妹交往，但交往後女方認為2人個性差異甚大，因此向男方提分手。男方帶女友到祖母住處，在神明廳內談判想挽回感情，但女方堅持分手，男子竟老羞成怒，在神明廳內以「狗爬式」性侵女友，他被依強制性交判處3年6個月徒刑；上訴高院和對方達成30萬和解，法官改判2年、緩刑3年，60小時義務勞務。

法院判決指出，該名男子在去年剛滿18歲時，在同年2月和小他1歲的國中學妹成為男女朋友。交往約半年時間，女方覺得2人個性不合，在同年7月提出分手。同月16日，男方藉口稱談分手，邀對方到台中市北屯區的祖母家中，並帶往4樓的神明廳，在神明和祖宗面前，發誓自己是愛著女友的。

男子哭求對方別分手，但女方仍堅持，男子突然情緒大變，先是強脫女友褲子，但女方反抗，正好男子的舅媽上樓祭拜祖先，男子停手。但根據《自由時報》報導，男子趁舅媽下樓後，又強脫女友褲子，最後女方反抗無力，被男方喝令以「狗爬式」姿勢性侵得逞。

事後女方提告，台中地院一審判處3年6個月徒刑，但男子不服提出上訴。高院審理期間，男子和女方達成和解，支付30萬並取得女方和解同意書，法官因此改判2年、緩刑3年，並得服60小時義務勞務。
