上凱道抗議油電雙漲　2議員有罪

前年5月12日及16日民進黨籍台南市議員王定宇、台北市議員童仲彥、嘉義縣議員黃嫈珺、高雄市議員陳信瑜、律師蔡易餘等5人，因抗議政府油電雙漲，和民眾聚集在台北市凱達格蘭大道上抗議，與警發生衝突，遭依《集遊法》、《刑法》妨害公務罪起訴，台北地院今宣判，《集遊法》部分5人均無罪，黃與童另遭依妨害公務罪各判20天及50天拘役，仍可上訴。

法官認為，並無證據顯示5被告是活動發起人，5人均未違法《集遊法》，法官認為黃嫈珺在女警抬離她時，有用手揮擊女警，童仲彥則是在活動中，用手拉扯警方盾牌並用手壓警員肩，認定2人均已涉及妨害公務罪，但法官認為，2人的犯行並不嚴重，因此均判拘役並可易科罰金每日1000元。（劉志原／台北報導）
