黃世銘回任最高檢主任檢察官？尚未定案

立法院法制司法委員會今天審查法務部業務，國民黨立委廖正井、呂學樟質詢法務部長羅瑩雪，檢察總長黃世銘被法務部監聽調查小組認為有監聽督不週的疏失，也被檢察官評鑑委員會列出七大缺失，四月黃世銘卸任，還適任檢察官嗎？還能派任最高檢察署主任檢察官嗎？

羅瑩雪表示，黃世銘卸任後是否派任最高檢察署主任檢察官，尚未定案。

據了解，法官組織法第六十六條規定，檢察總長任命時具司法官身分，卸任後「得」回任司法官。依此規定，黃世銘卸任後可申請回任檢察官，但是否能依他的意願派任最高檢察署主任檢察官還不一定，因為派任權力在法務部長。
