日月光案開庭 被告皆不認罪

（中央社記者程啟峰高雄29日電）高雄地方法院今天首度開庭審理日月光半導體公司排放廢水案，日月光廠務處長蘇炳碩等被告都不認罪，全案3月12日將再開庭。

高雄地院審理日月光案下午首度開準備庭，傳喚被告日月光公司廠務處長蘇炳碩、廢水組主任蔡奇勳、廢水組工程師何登陽、游志賢、劉威呈。

日月光派出10名律師辯護，由律師林石猛擔任日月光公司代理人，律師團針對檢方控訴的廢棄物清理法認為，檢方所採底泥並非法定規範的廢棄物，質疑其法律適用性。

蘇炳碩等人在庭上都不認罪。蘇炳碩說，去年10月1日K7廠強酸水溢流後，公司有緊急處理，並非直接讓水排出，並非故意污染後勁溪。林石猛也強調，排放廢水是設備異常的偶發應變事件。

法官當庭諭知，雖然檢方起訴認定被告故意排放污水，即便不是故意，刑法流放毒物罪也可處罰過失犯。

日月光K7廠被控去年10月1日偷排含鎳、銅有毒廢水污染後勁溪，日月光公司及蘇炳碩等5人被依流放毒物罪及違反廢棄物處理法起訴。日月光負責人張虔生、行政副總經理林顯堂則獲不起訴處分。1030129
