工讀生盜圖　燦坤賠PChome40萬元

台北市25歲的周姓男子，3年前在燦坤的網路銷售部門擔任時薪員工，每天負責上傳3C產品的廣告文宣到燦坤網路商城，但周男卻盜取網購平台PChome 24h購物的圖片和解說文字，放在燦坤網路商城上使用，被對方發現憤而提告，士林地方法院以違反著作權法判處周男2萬元罰金，緩刑2年，燦坤公司25萬元罰金，另外燦坤還須賠償PChome 40萬元。
 
周男到案後坦承從PChome網購平台竊取筆記型電腦的圖片，還有對方設計人員發想的圖說「人體工學巧克力鍵盤」等廣告詞，一字不改的挪用在燦坤網站上。
 
燦坤委任的律師則反駁對方拍的照片「沒有任何光影變化」、「沒有構圖等主觀創意」，認為對方不符合《著作權法》中保障的原創性要件，但法官不予採納。
 
法官審酌周男犯行，認為他薪資不高，每天卻要上傳100件商品和廣告文宣到燦坤網站，工作量太大，一時思慮欠周才會犯案，因此給予緩刑；反觀燦坤是每年實際營收高達16億元的大公司，卻讓時薪員工負責這麼龐大的業務，監督不周，判罰金25萬元還要賠PChome 40萬元。（吳珮如／台北報導）
