隔衣抓奶　無主觀犯意判無罪

宜蘭縣蘇澳鎮1名樊姓男子，去年6月底與2名友人在家門前烤肉，因巷弄狹窄，1名女駕駛因開車無法通過，下車與樊男等人理論。樊男不滿回嗆，並伸出左手掐推女駕駛手臂，還趁機以手掌隔衣抓胸4秒，女子大喊「變態」，樊男始收手。女駕駛不甘受辱提出性騷擾告訴，而同行的女駕駛母親與妹妹也證稱此事。
 
樊男偵訊時矢口否認有性騷及觸摸胸部行為，同行友人也作證並無肢體接觸。法院認為，樊男抓住女駕駛手臂時，左手大拇指及虎口碰觸女子胸部側面，加上女駕駛及其母、妹說法，研判可能是拉扯中不慎碰觸，女駕駛製作筆錄時也無法確定樊男有性騷擾意圖，加上無其他積極證據，法官依罪疑唯輕原則，認為證據不足，判樊男無罪。（林泊志／宜蘭報導）
