考紀會撤銷黨籍　王金平律師批積非成是

【張欽／台北報導】台北地院審理立法院長王金平黨籍確認官司，國民黨律師團表示，王金平擔任副主席5年期間，國民黨黨紀處分900餘次，撤銷黨籍524人，都由考紀會處分決定，王從未提出反對意見。
 
王金平律師許英傑反批，考紀會架構不是依民主原則運作，也不是《民法》、《人民團體組織法》規定的撤銷黨籍權責機關，依法終究要由司法機關審判，國民黨應提出具體的法律解釋，而非援引過去案例，否則恐有將錯就錯、積非成是之嫌。
 
審判長張瑜鳳表示，全案爭點在於國民黨應否撤銷王金平黨籍？程序是否有疏失？且政黨可否將權限移到黨內其他組織或機關？因涉及民主法治與政黨政治的整體運作，未來會請雙方充分表示意見。
 
合議庭諭知已調閱許舒博案及其他確認開除黨籍無效案例，請雙方閱卷參考，並裁示3月5日再開庭審理。
