文林苑王家要求原地重建　敗訴

【劉昌松／台北報導】台北市政府以公權力介入文林苑都更案，代建商樂揚建設拆除不同意都更的王家，王家打官司要求原地重建，台北高等行政法院上午宣判，判決王家敗訴。全案可上訴。上午雙方都未到法院聽判。

北市去年3月強拆文林苑都更案不同意戶王家，引起輿論抨擊侵害人民居住權，王家為護家打的首件訴訟敗訴定讞後，大法官今年4月為此做出釋憲，認為《都市更新條例》中，屋主、地主1/10同意的門檻過低，未確實保障人民權益，已經違憲，應在1年內檢討修正。
