因雇主欠薪離職 照樣可領失業給付

勞委會今天舉行記者會表示，不少勞工因老闆欠薪或未按時發放薪水，心想都白做工了，乾脆主動離職，勞工以為這類情事屬非自願離職，無法請領失業給付。勞委會說，這種離職事由肇因於雇主未依勞動契約給付工作報酬，雖是勞工主動離職，仍可視為非自願離職，可請領失業給付。

勞保局說，根據就業保險法規定，失業給付是按平均月投保薪資的六成發放，例如勞工離職退保時的平均月投保薪資是3萬元，可月領1萬8000元失業給付，最長可領6個月，共10萬8000元。
