| 韓亞航墜機 官方證實至少2死

【綜合報導】今日韓亞航一架從南韓首爾飛往美國舊金山的飛機，在降落舊金山國際機場時墜毀，舊金山官方稍早召開記者會證實，至少有2人死亡，82名乘客送醫，機上共有307名乘客與機組員。
官方也表示，有190名民眾自行逃生，但確切傷亡人數仍在調查中。

【陸運鋒／新北報導】今天清晨5時許，新北市板橋燦坤3C賣場位在重慶路上的分店突然竄出濃煙，警消獲報趕往現場搶救，仍尋找不到起火處，初步研判是牆內電線燒毀，目前已協同店家人員尋找卻起火點。

| 建商強佔土地 祕魯五千年金字塔付之一炬

【綜合報導】古蹟保育與城市發展間的矛盾，任何一個有歷史的城市都可能發生，南美洲的秘魯一座有5千年歷史的金字塔，被建商夷為平地，激怒考古學家與政府。
在秘魯首都利馬附近，有一座5千年歷史的金字塔El Paraiso，是美州大陸現存12座佔地64公頃以上的金字塔之一。1965年考古學家發現這座遺蹟，證實當地曾有1500至3000名居民，利用超過10萬噸的岩石，建造這座金字塔用作宗教與祭祀。
但當地2間建築公司為了開發這片土地，上周六(6月29日)竟將這座歷史悠久的古蹟夷平並焚毁。負責金字塔考古項目的專家表示，這2間公司自稱擁有這塊土地，祕魯當局則批評建商不擇手段。但破壞已無法彌補，當局除了痛心批評，也無法採取進一步行動。

兆文在事務所上班，公司規定遲到就要扣半天的薪水，兆文覺得這個規定很不合理。員工 遲到，公司可以扣員工薪水嗎？ 勞基法第22條規定，除非勞雇雙方另有約定，否則工資應該全額給付給勞工；第26條也規 定雇主不得預扣工資。換言之，除非有充分理由，基本上老闆不能任意扣薪，或片面減少 薪水。 但是，財團法人法律扶助基金會專職律師林靜文表示，在有固定上下班時間的公司，準時 是勞動契約的一部分。對於遲到的員工，雇主可以施以懲戒，扣薪資是懲戒的一種手段。 一般企業採用比較合理的方式，是以請事假來處理遲到，這也等於是減少薪水。 總體來說，在合理的範圍內，扣薪是雇主可以使用的手段。但是，如果老闆說，業績未達 目標要扣薪水，或是盤點出現短少情形的時候，要員工扣薪補足，這些都要看勞動契約上 是否有另行約定，和扣薪的程度。法令沒有明確規定，常以個案認定是否已影響到勞工的 生活為原則。 有時候，員工拿到薪水的時候才發現薪資短少，卻不知道原因。此時員工應該要求雇主提 供薪資明細，詳列加項和扣項，這樣員工才能在主張自己權益的時候，有所憑據。另一方 面，有些雇主會以工作不能勝任為理由減薪。 曾有過一個案例是，雇主以半年內業績未達目標為由，業務員每個月連續減薪10%。此時 ，員工主張老闆片面減薪已違反誠信原則，依勞基法第14條（參見下方）終止勞動契約， 反訴求資遣費，法院認為員工的主張有理，因為每個月連續減薪，已經達到影響員工生活 的程度，判雇主應發給員工資遣費。 不過，因為扣薪、減薪這一塊還是有模糊地帶，林靜文律師提醒，進入公司前一定要詳閱 勞動契約，包括月薪的總額是多少、保障年薪幾個月、包含年終算起來是多少，有沒有扣 薪或減薪的規定。實務上可能要扣薪達到低於年薪的70%、80%，員工訴訟才會比較有利。 薪資明細 不要亂丟！員工爭取權益的重要憑據 每個月5號薪水入帳，是上班族最期待的時候。不過，除了確認銀行帳戶的總數外，你是 否也曾注意過自己的薪資明細呢？ 勞基法上所稱的工資，實際上會牽涉到勞工的勞健保、資遣費與退休金，關係到勞工的權 益。勞基法第2條規定，工資是經常性給付。也就是說，不管薪資上的名目是加給、底薪 、伙食費或車馬費，以月薪制來說，每個月都會領到的薪水就是工資。 換句話說，雇主為勞工投保勞保的薪資級距，應該依照月薪總額，不能用底薪去算。雇主 每月提撥的勞工退休金（最低為勞工月薪的6%），也應當用月薪全額計算。雇主若以多報 少，可能會面臨勞工保險局的罰鍰，勞工也可以提起民事訴訟，終止勞動契約，請求資遣 費。 當勞工仍然在職的時候，只要每個月都領到薪水，通常不會感覺薪資名目的差異，但以業 績導向的業務人員或文字工作者，直接匯進戶頭的獎金、稿費不納入平均工資計算，這些 未列入薪資名目的項目，都可能壓低投保金額。 勞工可以檢查雇主是否按照薪資級距為自己投保勞健保和提繳退休金。林靜文律師建議， 如果員工不打算和雇主繼續合作，就應該保留至少6個月的薪資明細。因為資遣費的計算 方式是工作每滿1年給予0.5個月平均工資，而平均工資則是以前6個月的總額除以總日數 。保留薪資明細是員工爭取自己權益的重要憑據。 人事主管必讀！雇主不得預扣工資 勞基法規定，雇主不能片面更改勞動契約。因此，人事主管在訂定工作規則與相關罰則時 ，必須明文規定。此外，也要注意懲戒的方式和合理性。就以遲到扣薪為例，遲到以請事 假來代替，就是適當的懲戒方式。如果遲到要扣當天的薪水，就稍嫌過當。如果遲到要扣 明天的薪水，就違反了勞基法。 勞基法第26條規定雇主不得預扣工資，所以主管也不得以預扣工資做為懲戒方式。如果公 司以任何名目規定預扣員工薪水(例如預留餐費、清潔費等)都不合法。勞資爭議的處理方 式勞資爭議的處理機關，中央為行政院勞工委員會，各縣市為縣市政府。 解決勞資爭議的法定程序為調解、訴訟或仲裁。當事人可向主管機關申請調解，由中立第 三方協助達成雙方均可接受的方案。調解不成立者，雙方可再申請仲裁。或主管機關認為 情節重大，也可以直接交付仲裁（仲裁可分為：勞資爭議之仲裁與仲裁法之仲裁，勞資爭 議處理法第3條第4條) 來源： http://i.pubu.tw/12gPUIF -- ※ 發信站: 批踢踢實業坊(ptt.cc) ◆ From: 220.135.59.20

【綜合報導】玻利維亞總統專機昨日準備從俄羅斯飛回玻利維亞時，因外傳美國前報人員史諾登(Edward Snowden)被懷疑坐在飛機上，遭到法國、義大利、西班牙以及葡萄牙等國，拒絕進入領空，今日法國對此事表示道歉。
法國外交部發出聲明表示，對於「史諾登坐玻利維亞總統專機」一傳聞，法國外交部收到正確訊息的速度太慢，導致讓事件發生，法國對於玻利維亞總統莫拉雷斯(Evo Morales)相當抱歉。
昨日這架總統專機被迫停降在奧地利，奧地利政府也表示史諾登不在飛機上，隨後飛機飛回玻利維亞。

【王家俊／台北報導】有關苗栗大埔農地農戶拆遷爭議，副總統吳敦義下午出席藝文活動受訪時說，三年前苗栗縣長劉政鴻與內政部、營建署曾到行政院會商，找出基本共識，解決99％的爭議，剩下4戶，內政部都委會去年3、4月成立專案小組，今天準備把那個案重新拿出來討論。
吳敦義說，希望各方兼顧情理法，拿出成全的誠意，做決定。但他也沒把握，因為依照國家法律，主辦單位是苗栗縣政府，要尊重苗栗縣作為主管機關的權利，地方上有非常多意見、是尊重縣府採取的策略，希望兼籌並顧、多費苦心，一定要拿出誠意，把3年沒有明白說明的事情討論清楚。

| 滿意ONE更新4.2.2的一起喊聲給個讚吧!

昨天早上更新後隨手截了個圖就順順使用到現在
 按這裡檢視圖片
最有感的部分就是Zoe檔案的改變
終於不用在急著備份了，整理照片也方便好多
還有下拉式12宮格(回來真好)
我很享受一拉就可以調整功能的速度感
如果真心喜歡htc，我通常會走正常管道(例如客服)
以上的兩點都曾經寫信給htc反應，沒想到這次更新就改善了
但大部分的人不會上網分享貼心事，不理性的攻擊倒是在新機發表或更新後如雪花般飛來~~~
最近火力凶猛的大概是紫光與客服抱怨上
我相信一定有消費者遇到以上問題~
但有些耐人尋味的文章，真的在考驗判斷力(例如下方)
1圖文並茂抱怨文，都有維修單(但通常都後補?)
2新申請的帳號都會先消毒不是工讀生是某某正職
3標題聳動即使有帳號被停權的可能也在所不惜
Ex:…讓我極度失望、打敗、這樣正常嗎?要送修嗎?.....還會有這個問題嗎?
4周末文(大家明白滴)
抱歉可能誤傷一些人，但簡單來說，如果有些問題(紫光)一直被重複討論應該會先爬文尋求解決!
因為一開始的問題都會被熱心解決或者得到好的建議~
一再抱怨只會讓人疲乏
也許是HTC One跟Butterfly太成功了吧!而且彼此升級後都可以滿足更多既有與未來用戶!
像我就是無法抗拒這兩支旗艦所以都有購入XD目前也都滿意使用中
ONE更新後更是優點都發現不完了!
有大大更新後更想好好呵護這支手機的給個讚吧!!
