（續前文） 其實前一篇文有板友已經提到一些概念 在此嘗試做更完整的敘述 為什麼我覺得古美門超適合打刑事訴訟 （一樣有微雷，一樣有枯燥的法律） 2. 刑事訴訟 刑事和民事有著根本的不同 刑法是公法，而民法是私法 刑法基本上是憲法基本權保障的具現， 一旦有人基本權受到侵害（ex. 被殺），而國家還默許之的話， 那這個國家就要人人自危、分崩瓦解了 因此刑事訴訟的兩造，是檢察系統（國家） vs. 被告 和民事訴訟兩造都是私人有所不同。 私法自治那套：「你我合意就ok，真相如何其實未必重要」在刑法完全不適用 試想： 「你（被告）想死，我（檢方）也想讓你死，那你就死吧！」 這合理嗎？ 如果是如此，那小雪應該已經被槍斃了， 人是不是她殺的也不管、真兇逍遙法外也無所謂。 刑事訴訟法注重的是「發現真實」，並且根據真實來判斷被告有無該當罪責。 但是大家都知道人非神，不可能100%還原真相 因此所謂「真相是越辯越明」這種理念相應而生（當然也受到不少挑戰） 檢辯雙方的制度設計以此為基礎誕生 期望這至少能讓「法庭上的真實」更接近絕對真相 在這裡，律師要保護的是被告的天賦人權 這權利不能由被告自己拋棄 這也是為何刑訴法規定被告自白不能成為定罪的唯一原因的理由 不論被告自我的意願是怎樣，被告的權利還是必須被保護 這就是為什麼我覺得古美門能在刑訴案件大展身手的原因 因為刑事案件相較民事案件 可以不管民事案件中常常要顧及的委託人主觀想法，或是人際溝通的智慧 可以不顧一切的為被告的權利戰鬥（當然還是不能用違法手段喲～） 出動蘭丸揭發檢方提出的證據瑕疵、找到證人作出反證等等 都是將辯方角色發揮到淋漓盡致的展現 也唯有如此強大的古美門 才能在「一個平凡的升斗小民」vs. 「國家追訴機器」這樣的對抗中 達到武器平等的目標 （要說武器最平等的話當然還是古美門v. 古美門） 以上是對於刑事訴訟一些粗淺的理解， 其實刑訴中可以討論的東西還有很多，例如傳聞證據、毒樹果實理論等等， 在此就咨不贅述了。 最後，我欣賞古美門在S2E1當中對小雪說： 「不論你是賤人婊子殺人犯，我都會讓你無罪」這樣的氣魄，帥呆了！ 還有，我想Mr. Win-Win那套，在刑事案件是無法適用的 （難不成羽生真的要去當陰陽師？） -- ※ 發信站: 批踢踢實業坊(ptt.cc) ◆ From: 1.163.216.97

【周佩萱／綜合外電報導】印度南部懷傑意那古侖(Vijainagaram)2日晚間發生乘客行走在鐵軌上，遭火車撞擊輾過，造成至少8死12重傷。

事發是由於乘客誤以為車廂起火，自行拉下緊急停駛把手，火車停止後，乘客紛紛跳出車廂逃命，在鐵軌上行走時，遭另一輛行駛而來的火車撞擊。

因為事發已是晚上，發生地點偏遠沒有足夠的光線，增加搜救難度。

【周佩萱／綜合外電報導】加拿大一探險家現年44歲的馬可拉佛伊(Marco Lavoie) ，7月中旬時帶著愛犬前往距離蒙特婁約800公里的諾塔威河(Nottaway river) ，展開為期3個月的單人野營探險，但才紮營沒幾天，營地遭野熊入侵，野熊吃光他的存糧，並將唯一的交通工具獨木舟弄壞，當時還是靠心愛的寵物德國牧羊犬將野熊擊退，才保住一命。

在沒有存糧，獨木舟也被破壞，又無法求救的狀態下過了數天後，拉佛伊為了生存，狠下心用石頭砸死愛犬，靠吃愛犬果腹，過了3個月，家人發現他沒有照計畫中的時間回來，才報警搜救。

經過數天搜尋，10月30日搜救人員發現拉佛伊，當時他幾乎無法說話也無法進食，但所幸沒有發現太晚，拉佛伊經過休養現已逐漸恢復健康，這段驚人求生故事遭當地媒體報導後，引發不少回響，不少人認為吃掉自己的愛犬也太狠心，不過野地求生專家表示拉佛伊做了正確的選擇，不然他早就喪命了。
